TERMS OF SERVICE
An outline of the terms of procurement, contract, and distributing or use of art by EXANAMISThank you for your interest in my art and supporting my passions and dreams. Before inquiring about my prices, or proceeding with a submission of request, ensure you read these in full. By entering a commission agreement and submitting payment you acknowledge you have read and agree to all listed terms.If you're looking for design terms of use, they're at the bottom of the page!I. SKEB/YGWYG Options (NOT APPLICABLE TO OTHER LISTINGS)Options listed under YGWYG (You get what you get) or SKEB are commission options left fully to artist interpretations. No work-in-progress photos are provided, and the only edits that may be requested are for missed or wholly incorrect markings or features. Request may be made to themes or imagery, but the final composition and piece is entirely at my discretion. Please do not use these options if you do not appreciate or agree with that concept.II. Payment ProcessingPayment is processed via VGen commission request, Paypal, or Stripe invoice. Invoices will be written to designate the payments for digital goods, they will not have any mention of ‘furry’ or ‘anthro’ specifically due to changing definitions and service terms towards art considered not safe for work.Payment is expected to be made upfront, and made within 24 hours of invoice submission. Payment plans are subject to case-by-case approval and will only be considered for orders crossing the $300 pricepoint.III. Age Restriction & Characters AgesCommissions, regardless of their content, are only available to users 18 or older. If any characters are owned by anyone other than the purchasing party, the owner of those characters must also be 18 or older. I will attempt to verify based on listed age in social media bios and publicly available discussion, and if I have a reasonable doubt about your age I may request to see some form of identification. In this case, the name & dob must be shown on your ID and must match the name attached to your fiscal account.I only depict characters that are 18 years old or older but will make rare exceptions in certain SFW settings. Characters that are designed or heavily perceived as minors may be rejected or requested artistic liberty to make changes to their design for my comfort.IV. Deadlines and RevisionsI DO NOT work under a strict deadline. During holidays, I will publish a ‘last call’ date which will state the last day an inquiry can be submitted for completion before a major holiday. If you have a date you would need a piece completed by and there is at least 3 weeks before said date, I will do my best to adhere to said deadline.Revisions are offered at two points; One at the sketch phase, and one at the rendered phase. I work in a semi-SKEB style in which I take a decent amount of artistic liberty with my pieces but want to provide work that my clients are happy with. Changes to pose or backgrounds can be made at the sketch phase. At the rendering phase, changes to markings or color can be made.Please speak up if you are unhappy! I will not take offense to ensuring you are pleased with the product you receive. I will not take revisions of submitted characters for a piece after a sketch has been submitted.V. Refunds, Chargeback, & GhostingI will only offer full refunds up until the sketch is delivered and approved. After that point, only partial refunds of 50% the total commission cost are available, unless a situation arises in which I cannot complete your artwork. For fully SKEB/Commissions without WIPs, no refunds are available outside of extenuating situations (such as I am unable to complete your artwork within a timely manner).I try to have art completed within the same month it was commissioned, or the following month. If the art has been in the same phase, such as sketch/linework/flat color for 4 months, it is no longer considered timely and clients are entitled to request a full refund. This is only unless the client agrees to a longer wait time due to extenuating circumstances (i.e. emergency commission listing, special opening when otherwise closed, etc.) and has waived this eligibility.Chargebacks/Disputing payments with zero communication regardless of situation will be an immediate black list, and depending on the amount may lead to myself pursuing legal action in civil courts.Ghosting after inquiring about a commission is a blacklistable offense. If your situation changes or the commission is out of your budget, or even if you just don’t want to continue, that is fine and I will never take it as a personal offense! Please communicate this so I can plan accordingly for slots and availability. Ghosting multiple times will lead to permanent blacklisting.

Use of WorkI retain all rights to my artwork unless contracted and compensated for commercial rights. You may not distribute my work for profit in any way, including but not limited stickers/tee-shirts/convention pins/etc. You may upload my work to sites such as Toyhouse with proper credit to my Toyhouse account, or on other sites with my proper credit on each site. My social media can be found on my website.UNDER NO CIRCUMSTANCES CAN YOU UPLOAD MY ART TO TRAIN, TEST, OR IN ANY WAY INTERACT WITH ARTIFICIAL INTELLIGENCE GENERATION OR ANY OTHER VECTOR OF TRANSFORMATIVE OR GENERATIVE COMPUTER SOFTWARE. You MAY NOT apply an AI filter, generate AI text, or perform any such actions on my art.I will post any and all art I make unless specifically asked to refrain from doing so; If the work needs to stay private PLEASE let me know beforehand. A NDA fee may apply.My work may be added to a character's value only if commissioned and cannot be used to inflate value if the art is gifted or traded for. My work may not be drawn over.VII. Racist, Homophobic, or Hateful imagery of any kindI retain the right to decline any commission due to subject matter even if that subject is not listed here.Complex designs (including but not limited to lots of piercings, multiple gradients, small/intricate markings, detailed tattoos, and multiple limbs/heads/etc.) may be subject to a complexity charge, as small as 5% and not to exceed 35% of the final artwork price.VIII. Design - Terms of UseYou may only sell a design you got through purchasing directly. You may only sell a design for its total worth of commissioned artwork at the price each commission was at time of purchase. You may only trade designs if they were traded or gifted to you, under no circumstances may you sell designs you did not pay for directly.You may not make sibling designs/copied designs from my design work. Trading or selling my designs to blacklisted individuals will lead to you being blacklisted as well.If found you are using my design for hateful content (racist/homophobic/misogynistic/promoting harm to children or sexualizing children/etc.) you will be permanently blacklisted and I will revoke the design without compensation.Co-ownership is allowed but I will not handle ownership disputes between future co-owners and will only involve myself if there is theft going on.
